Claude Deeter, the white man killed by the colored boys, died about 1:30 in the afternoon. Immediately crowds began to gather in the streets and threats were openly made that Smith and Shipp would be lynched that evening. Deeter's blood-stained, bullet pierced shirt was hung out of the front window of the Marion City building, this being done. James Cameron stated in interviews that Shipp and Smith had, in fact, shot and killed Claude Deeter, a white man. Cameron claimed that he fled when he realized what was going on. So the guys are guilty of murder. The rape allegation — although it, and not the homicide, seems to have been the thing that triggered the lynching — was.
Shipp, who is said to have confessed killing the white man, Claude Deeter, 23, of Fairmount, Ind., was hanged from an elm tree in the courthouse yard. Smith, whom the girl identified as her assailant, was thrown from a third floor window of the jail with a noose around his neck and strangled. Carl Deeter is the nephew of the young man, Claude Deeter, whose killing was one of the justifications for the lynching. He talks about how Claude's parents, farmers Grace and William Deeter, went to the mothers of their son's killers to express their forgiveness and lament the lynchings Claude Deeter and Mary Ball. Mary had had the audacity to come to the Deeter house for the wake, where she announced to the family that she and Claude were almost engaged. According to Willie Deeter, he had never heard of Mary Ball's name before that night. No one else in the family ever heard of her either (Carr, pg. 310) The black youths had been involved in the robbery-inspired murder of Claude Deeter, 23, a white factory worker from nearby Fairmount, Indiana, and were accused of sexually assaulting Deeter's white girlfriend, nineteen-year-old Marion resident Mary Ball. While the latter charge was never proven, such charges, however groundless, were easily. The trio had been driving along the river when they came upon 24-year-old Claude Deeter and 18-year-old Mary Bell. Cameron says that Shipp and Smith wanted him to rob the couple and handed him a gun. When Cameron realized he knew the couple, he walked away from the scene. He then claimed he heard gunshots a short time later
He said in interviews that Shipp and Smith had shot and killed Claude Deeter. Flossie Bailey , a local NAACP official in Marion, and Attorney General James M. Ogden worked to gain indictments against leaders of the mob in the lynchings, but the Grant County grand jury refused to return an indictment.
